Allott and Associates is supporting its client base to navigate the varied changes as a result of Brexit, by providing guidance on the measures that need to be taken by businesses, such as data processing following the change from GDPR to UK GDPR. This came into force at the beginning of January 2021 and affects all businesses including the public sector and charities.

Unlike GDPR, UK GDPR applies to any data processing undertaken in the UK no matter where the client or customer is based in the world. This means you must extend data subjects’ rights and other legal obligations to everyone in the world, not just those located within the UK and EU.

If you are involved in any international personal data exchanges you should undertake a UK GDPR audit because the changes coincide with a breakdown during the last six months of the US Privacy Shield. So, if you are sharing any personal data with another company in the US – whether a subsidiary, head office, or even a supplier like MailChimp – you must put in place appropriate transfer documentation or risk a heavy fine.

Meanwhile, life outside the European Union should not be too disruptive in the long term as the UK is committed to remaining in broad sync with EU data protection legislation. Currently the UK is pending an adequacy ruling from the EU; adequacy is a test applied by the EC to determine whether third countries (like the UK) have similar data protection rights as the EU. If the UK is granted ‘adequacy’ the free flow of personal data will continue within the European Economic Area (EEA) without any new restrictions – subject to compliance with UK GDPR.
